3. Student Suspension Due Process Appeal Hearing for Student "A"
a. The Board President will ask Student A’s parent or designee whether he/she wishes the hearing to be in open session or in executive session. If Student A wishes the hearing to be in executive session, then the Board will consider and vote to go into executive session pursuant to OKLA. STAT. tit. 25, § 307(B)(5) to hear evidence and to discuss the suspension of Student A. Also, the Board can consider and vote to go into executive session pursuant to OKLA. STAT. tit. 25, § 307(B)(7) at any time during this hearing where disclosure of information would violate confidentiality requirements of state or federal law. c. Opening statement by Student A or his designee. d. Presentation of all the administration’s evidence subject to cross-examination by Student A or his designee and questions from the Board of Education, if any. e. Presentation of Student A’s evidence subject to cross-examination by the administration and questions from the Board of Education, if any. f. Presentation of rebuttal evidence and surrebuttal evidence, if any. g. Closing statement by Student A or his designee. h. Closing statement by administration or its designee. i. Deliberation by Board of Education. [If the hearing is not held in executive session, then the Board may vote at this time to go into executive session, pursuant to OKLA. STAT. tit. 25, § 307(B)(5) & (7) to discuss and deliberate on the suspension of Student A since disclosure of information would violate confidentiality requirements of state or federal law.] j. Vote to acknowledge return to open session. k. Statement of executive session minutes. l. Motion and vote to adopt findings of fact on the suspension of Student A, which shall include a determination of the guilt or innocence of Student A and the reasonableness of the term of the out-of-school suspension. m. Motion and vote to affirm and uphold the suspension or to revoke the suspension of Student “A” in whole or in part.

a. The Board President will ask Student B’s parent or designee whether he/she wishes the hearing to be in open session or in executive session. If Student B wishes the hearing to be in executive session, then the Board will consider and vote to go into executive session pursuant to OKLA. STAT. tit. 25, § 307(B)(5) to hear evidence and to discuss the suspension of Student B. Also, the Board can consider and vote to go into executive session pursuant to OKLA. STAT. tit. 25, § 307(B)(7) at any time during this hearing where disclosure of information would violate confidentiality requirements of state or federal law. c.
