To acknowledge the return to open session at 7:45 pm passed with a motion by Jeff Gilbert and a second by Bryan Sherwood.

I move, based on the presentations made at this pretermination hearing, that the superintendent’s recommendation of dismissal of Jennifer Kroll be accepted and that Jennifer Kroll be dismissed from her employment with the Sapulpa School District effective immediately based on the following underlying facts and statutory causes: 1. Jennifer Kroll is a career teacher. Her current teaching assignment is at Sapulpa Middle School as a social studies teacher. 2. On or about August 28, 2009, Sapulpa Police were dispatched to Ms. Kroll’s residence regarding reports of a man with a shotgun. The man in question was Earnest Shaw, a man who lives with Ms. Kroll. Ms. Kroll was not present at the residence when the police arrived. After dealing with various issues of alleged criminal conduct by Mr. Shaw, the police were advised by Mr. Shaw that his baby [which is also Ms. Kroll’s child] was inside the apartment alone with his dogs. Shaw stated that the dogs would bite anyone who entered the apartment. As a result, a Sapulpa Animal Control officer and two Sapulpa police officers entered the house and secured the baby. The officers found three adult pit bull dogs and eight eight-week old pit bull puppies in the apartment near the baby. The baby was found face down on a mattress in an upstairs bedroom with dog feces all around. A Sapulpa Police officer present in the apartment has stated that “the condition of the apartment was horrendous with a putrid smell that was sickening. Dog feces and urine along with garbage and overturned furniture littered the apartment.” This same officer stated that “[d]ue to the age of the baby, the inability of the baby to move, and [the] amount of dogs present, a tragedy was inevitable without intervention.” By Ms. Kroll’s own admission to me, she knowingly, voluntarily and repeatedly has left her baby in these conditions and under the control of Mr. Shaw. Further, Ms. Kroll has told the superintendent that she and the baby have lived in these “horrendous” conditions for many months. 3. Ms. Kroll’s conduct provides the following statutory causes for her dismissal: (1) commission of acts of moral turpitude, (2) mental and physical cruelty to a child, (3) incompetency, and (4) willful neglect of duty [OKLA. STAT. tit. 70, § 6-101.22 (Supp. 2003)]. 4. If this motion is approved then the clerk of the board of education should notify Ms Kroll, on behalf of this board of education, in writing, and by appropriate process required by law, of the board’s decision and the basis for the decision and of her right to petition for a trial de novo in the District Court of Creek County. passed with a motion by Wally Johnson and a second by Bryan Sherwood.
